Johnny Gaudreau,Matthew Gaudreau Obituary, Death; – The individual accused of causing the deaths of NHL player Johnny Gaudreau and his brother Matthew while they were cycling on a rural road had a blood-alcohol concentration of .087, exceeding New Jersey’s legal limit of .08, as stated by a prosecutor on Friday.
Gaudreau, aged 31, and his 29-year-old brother Matthew lost their lives in Carneys Point, New Jersey, on August 29, just one day prior to their roles as groomsmen at their sister Katie’s wedding. The accused, 43-year-old Sean M. Higgins from Woodstown, New Jersey, faces two counts of death by auto, in addition to charges of reckless driving, possession of an open container, and consuming alcohol while operating a vehicle.
During a virtual court session on Friday, a judge ruled that he would remain in custody pending trial, despite defense claims highlighting his status as a married father and previously law-abiding citizen. Defense attorney Matthew Portella remarked, “He’s an empathetic individual and a loving father of two daughters. He’s a good person who made a terrible decision that night.”
According to the criminal complaint, Higgins informed law enforcement that he had consumed five or six beers that day and acknowledged drinking while driving. He also failed a field sobriety test. A prosecutor revealed that Higgins had been drinking at home after completing a work call around 3 p.m. and following a distressing conversation with a family member.
Additionally, Higgins has a documented history of road rage and reckless driving, as noted by First Assistant Prosecutor Jonathan Flynn of Salem County. Flynn indicated that Higgins became frustrated when the two vehicles in front of him slowed down to navigate around the cyclists, prompting him to accelerate in an attempt to pass them on the right, ultimately colliding with the Gaudreaus.
Superior Court Judge Michael J. Silvanio remarked that Higgins admitted to being “impatient,” which led to the tragic deaths. Higgins could face a maximum sentence of 20 years, a prospect that the judge indicated rendered him a flight risk.
Higgins holds a master’s degree, is employed in finance at an addiction treatment firm, and has served in combat in Iraq, according to his legal representation.
