Edgar Barrios Arrested; – A man has admitted guilt to charges of driving under the influence of cannabis, resulting in a collision that claimed the life of a four-year-old girl.
Edgar Barrios, 22, from DeKalb, entered his plea on Wednesday in Kane County court to aggravated DUI resulting in death and aggravated DUI resulting in great bodily harm. Sentencing is scheduled for February 26, presided over by Judge D.J. Tegeler. In exchange for his plea, all other charges, including reckless homicide, have been dismissed.
Barrios faces the possibility of probation or a maximum sentence of 14 years in prison for the death charge. He has been held in the Kane County jail since his arrest in November 2022. The incident occurred on October 1, 2022, on Route 38, east of Meredith Road, near Maple Park.
Kane County Assistant State’s Attorney Dave Belshan reported that Barrios was traveling east on Route 38 in a Chrysler 200 when he lost control, veered off course, and collided with a Jeep Compass. At the time of the crash, he was driving approximately 77 mph in a 55 mph zone. The Jeep subsequently went into a ditch and ignited. Paityn Moore of DeKalb, who was secured in a car seat, succumbed to her injuries at Lurie Children’s Hospital in Chicago, while her mother, the driver, also sustained injuries.
Following the impact with the Jeep, Barrios collided with a westbound Subaru Forester. According to Belshan, Barrios had a blood concentration of 6.6 nanograms per milliliter of THC-Delta 9, exceeding the legal intoxication threshold of five nanograms in Illinois.
