Timothy Drake Arrested; Suspect charged in Kill Devil Hills shooting

Timothy Drake Arrested; – On the morning of Monday, December 1st, the Town of Kill Devil Hills issued a report regarding the shooting incident that occurred over the weekend.

On Saturday, November 29, 2025, at around 10:15 p.m., officers from the Kill Devil Hills Police Department responded to a report of gunfire, which was later updated to indicate that an individual was suffering from gunshot wounds in the 1900 block of South Croatan Highway.

Upon arrival, officers determined that the victim, Christopher Whitehead, a 53-year-old resident of Kill Devil Hills, had sustained gunshot wounds in the 100 block of East Fresh Pond Drive. Through their investigation at the scene, officers identified the shooter as Timothy Drake, a 40-year-old resident of Kill Devil Hills, who was present nearby and fully cooperated with law enforcement.

At the request of the investigators from Kill Devil Hills on the scene, the North Carolina State Bureau of Investigation (NC SBI) arrived to provide assistance in a limited capacity. After reviewing the evidence and consulting with the District Attorney’s Office of the First Judicial District, the Kill Devil Hills Police investigators established probable cause to charge Drake with Assault with a Deadly Weapon Inflicting Serious Injury. Drake was taken into custody without incident and transported to the Dare County Detention Center, where he was issued a $15,000 unsecured bond.

Dare County EMS provided initial medical assistance and transported Whitehead to The Outer Banks Health Hospital in Nags Head. The victim was subsequently transferred to Sentara Norfolk General Hospital, where he is currently in stable condition.
