James Andrew Evans Obituary, Death; No charges for officers who fatally shot man during gunfire exchange in James City County

James Andrew Evans Obituary, Death; – Two James City County police officers will not face charges after fatally shooting an armed man in March, according to the Williamsburg-James City County Commonwealth’s Attorney’s office.

A man, who was identified as 57-year-old James Andrew Evans, was killed on March 30 after exchanging gunfire with police in James City County. Investigators found that both officers used deadly force on Evans, but only after he threatened them with deadly force.

 

The incident started at 4:38 p.m., according to James City County Police. They were called to a potentially armed male suspect in the 100 block of Dehaven Court, but before they arrived, Evans fled the scene in a green Nissan truck.

Using Flock technology, officers found the truck driving toward Olde Towne Road. Two officers followed it into the Food Lion parking lot. There, officers say Evans got out of the truck with a long rifle.

The investigation showed that when police confronted Evans, he was holding a rifle and ignored repeated orders to put it down, officials say. He then reportedly put the stock of the gun against his shoulder and aimed at the officers, which is when one officer shot Evans in the leg.

Evans fell to the ground near the gun. When the officers approached to try to detain him, he got the gun again and started shooting indiscriminately, officials say. At this point, both officers shot Evans multiple times, leading to his death, investigators reported.

Because he was on the ground and moving around, Green does expect that the medical examiner’s report will show at least one gunshot wound to the back. After the shooting, the officers were not injured and were placed on non-enforcement, modified assignment pending the outcome of the investigation.
