Justin Diaz Obituary, Death; – An off-duty firefighter from the FDNY has been charged with driving under the influence following a fatal accident in Queens on Wednesday, as reported by law enforcement officials. The individual has been named as Michael Pena, 28, who is also facing charges of second-degree vehicular manslaughter and refusal to submit to a breathalyzer test.
The incident occurred on Northern Boulevard at approximately 4:15 a.m. in East Elmhurst. A 24-year-old man, identified as Justin Diaz from Brooklyn, was operating a 2022 BMW northbound on 107th Street when it was collided with by a 2015 Mercedes traveling east on Northern Boulevard.
Diaz was transported to NYC Health + Hospitals/Elmhurst, where he was later pronounced deceased, according to previous reports from Patch. The two passengers in the Mercedes were also taken to NYC Health + Hospitals/Elmhurst and are currently in stable condition. Pena, the driver of the Mercedes, was apprehended by police following the incident.
